Of Rawls and galaxy clusters

Not long ago in calendar time, though something like an eon ago in blogosphere time, a commenter on a Crooked Timber thread asked why Rawls limited his theory of justice to humans.  Why, this commenter wondered, are only humans deliberating in the hypothetical original position, behind the 'veil of ignorance'?  Why not, say, non-human animals, or even "clusters of galaxies"?  At the time I responded sharply and rather impolitely and got into a spat (a 'flame war', in blog-speak), rather than trying to answer calmly.  This post is my  belated attempt at a calm answer.  (Note: My knowledge of Rawls comes mainly from the original edition of A Theory of Justice (1971) [hereafter TJ], which is what I cite here.  Rawls revised or changed his views on some points after the first edition of TJ, but I don't think he changed his views on the point that is germane here.)

Rawls makes clear in TJ that, following Hume, he assumes as one of the background conditions of his project the presence of "the circumstances of justice," that is, the objective and subjective circumstances "under which human cooperation is both possible and necessary" (p.126).  The key conditions are that individuals "have different ends and purposes" that lead them "to make conflicting claims on the natural and social resources available," which resources are assumed to be moderately scarce (p.127).  I think  Rawls sees t
hese conditions as having characterized most (if not all) societies, including the relatively affluent Western societies of the mid-twentieth century.

It's this emphasis on the Humean "circumstances of justice" that underlies Rawls's position that his theory is "a theory of human justice" (p.257, italics added).  The theory does not apply to non-human entities or non-human societies that may not be subject to the constraints imposed by the circumstances of justice.  Rawls writes (p.257):
...I have assumed all along that the parties [in the original position] know that they are subject to the conditions of human life.  Being in the circumstances of justice, they are situated in the world with other men who likewise face limitations of moderate scarcity and competing claims.  Human freedom is to be regulated by principles chosen in the light of these natural restrictions.  Thus justice as fairness is a theory of human justice and among its premises are the elementary facts about persons and their place in nature.  The freedom of pure intelligences not subject to these constraints, and the freedom of God, are outside the scope of the theory.
And presumably for much the same reasons, galaxy clusters are also outside the scope of Rawls's theory.

'Supreme emergency' revisited

Update: Walzer gave a lecture on supreme emergency in 1988 at the U.S. Air Force Academy, reprinted in his Arguing about War (2004). 

A recent Crooked Timber thread, attached to this post, got into both empirical and moral questions about Allied bombing in WW2, including the atomic bombings. In connection with this I've been urged by Anderson to read part of Richard Frank's Downfall (which I'm planning to do).

The CT discussion led me to take another look at something which, unlike Downfall, I already have on the shelf: Michael Walzer's chapter in Just and Unjust Wars on "supreme emergency," the phrase Churchill used to describe Britain's situation in 1939 (see p.251). Walzer's argument, in brief, about the bombing of German cities is that early in the war, when "Bomber Command was the only offensive weapon available to the British" (258), the real possibility of an imminent German victory constituted a supreme emergency, i.e., the sort of rare situation which "might well" (259) have justified overriding the norms/rules of war (which he calls 'the war convention') and engaging in city bombing, which was the only thing, at that point, that the bombers could do, given their crude navigational equipment and consequent lack of precision. However, despite improvements in navigation etc. and, even more importantly, the changing military situation, bombing of cities continued until almost the end of the war. "[T]he supreme emergency passed long before the British bombing reached its crescendo. The greater number by far of the German civilians killed by terror bombing were killed without moral (and probably also without military) reason," Walzer writes (261).

Walzer rejects, on moral grounds, the defense of city bombing given at the time by Arthur Harris (head of Bomber Command) and others to the effect that it would hasten the end of the war and thus, on balance, save lives. The passage in which Walzer explains his view is worth quoting (albeit in abridged form):
The argument used between 1942 and 1945 in defense of terror bombing was utilitarian in character, its emphasis not on victory itself but on the time and price of victory. The city raids, it was claimed by men such as Harris, would end the war sooner than it would otherwise end and, despite the large number of civilian casualties they inflicted, at a lower cost in human life. Assuming this claim to be true (I have already indicated that precisely opposite claims are made by some historians and strategists), it is nevertheless not sufficient to justify the bombing. It is not sufficient, I think, even if we do nothing more than calculate utilities. For such calculations need not be concerned only with the preservation of life. There is much else that we might plausibly want to preserve:...for example,...our collective abhorrence of murder.... To kill 278,966 civilians (the number is made up) in order to avoid the deaths of an unknown but probably larger number of civilians and soldiers is surely a fantastic, godlike, frightening, and horrendous act. (261-62; textual footnote omitted)
He goes on to say that though "such acts can probably be ruled out on utilitarian grounds," it is only when "the acknowledgment of rights" comes into the picture that we are compelled "to realize that the destruction of the innocent, whatever its purposes, is a kind of blasphemy against our deepest moral commitments" (262).

The amendment I'd make here would be to replace the word "innocent" with "non-combatant." Why? Because if an 'average' civilian is innocent, so an 'average' soldier, one who has not committed atrocities but simply participated in battles or worked behind the lines, may also be, in some relevant sense, innocent. What is he guilty of, other than doing what soldiers are expected to do? The appropriate distinction, it seems to me, is not between innocent and not-innocent but between non-combatant and combatant. Putting aside the word "innocent" means that one doesn't have to inquire into any particular non-combatant's actions or, in the case of Nazi Germany, awareness of genocide, which a fair number of German civilians probably had. It was their status as non-combatants, not their "innocence," which made deliberately killing them, especially after the supreme emergency no longer existed, unjustifiable.

Moral action in the real world

An ongoing exchange at Duck of Minerva between PTJ (here) and Phil Arena (here) raises some interesting questions about rational choice theory and moral action (among other things).

PTJ argues that "moral action strictly speaking" does not take any account of an individual's preferences or desires and that choice-theoretic models therefore rule out moral action by definition.

I don't want to get deeply into the argument about rational choice theory for several reasons (one of them being that I don't care that much about it one way or another), but I do want to raise another issue -- albeit not that systematically or even coherently, given the hour.

The issue is this: does anyone engage in "moral action strictly speaking" in the real world? That is, does anyone act without taking into account his or her own desires, at some level? To some extent this is a semantic question: one can always say that because X did Y, X wanted to do Y. Mother Theresa must have wanted to minister to the poor of Calcutta (Kolkata), otherwise she wouldn't have done it. But the use of "want" in this way begs the question. More pointedly, one can suggest that of course Mother Theresa acted out of moral and religious conviction but presumably it must also have given her satisfaction, in some sense that can be separated from acting purely out of a sense of moral duty. At least, it's not absurd to think that might have been the case. (And if you don't like the Mother Theresa example, substitute one of your own choosing.)

There are at least a few philosophers who think, as Iris Murdoch remarked, that "every second has a moral tinge," that we are constantly faced with moral decisions. This, I think, is an overstatement: there are large swaths of mundane daily life that do not have a moral tinge. But even if only ten percent of one's existence involves moral questions, that's still a lot. And I think ten percent might be on the low side.

The point I'm trying to get to, though, is that real-world decisions usually involve a mix of considerations, in which one balances what one thinks or knows is the right thing to do, abstractly speaking, against the inconvenience or cost to oneself which doing that thing might entail. After all, if Christians followed Christ's example literally, they would live in poverty and give all their wealth and possessions to the less fortunate. Ditto for Jews and Muslims who followed the relevant scriptural injunctions for them. Of course monks and saints might do that, and the WaPo recently ran an article about some young people in well-paying jobs who give most of their income to charity (having been influenced by, inter alia, the writings of Peter Singer), but most people balance the imperatives of their moral and/or religious beliefs against the practical costs of operationalizing those beliefs. I give a small amount of money each month to an organization that works against global poverty. Could I give more? Yes. Why don't I? Because there are other, mostly less selfless (or more selfish, if you prefer to put it that way) calls on a finite amount of resources.

So, to come back to rational choice theory, even if it does rule out "moral action strictly speaking" by definition, if few people engage in such action in the real world, I don't know that the exclusion-by-definition greatly matters -- especially if you assume that ultimately the point of even highly stylized models is to advance understanding of the real world.

Democracy and individual capacities: a postscript on Knight & Johnson

Before returning Knight & Johnson's The Priority of Democracy to the library, I want to mention something I neglected to mention in my earlier post on the book. It concerns K&J's reference to Rawls in their discussion of "the relevance of individual capacities" in ch.8. They write:
Our pragmatist defense of democracy envisions active participation by citizens in processes of mutual discussion and persuasion. Such participation requires that each citizen be able to advance arguments that others might find persuasive. Thus, equal opportunity of political influence must attend to the conditions under which all citizens would be able to engage in discussion at this level. The depth of the anticipated participation highlights the importance of the effects of individual-level capacities for effective institutional performance. (p.234)
In other words: One of the requirements for democratic institutions to work properly is that individuals must have the capacities (abilities) to participate effectively in deliberation. Presumably that means that most adults must be able to speak and/or write coherently enough to have the possibility of persuading others of their point of view.

Knight & Johnson proceed to criticize Rawls for paying "no explicit attention to issues of equality of capacity" (p.236). Citing Rawls's Political Liberalism [PL] (1993), they note Rawls's statement that everyone must have "a fair opportunity...to influence the outcome of political decisions" (PL, p.327). But, K&J continue, Rawls
limits analysis of [this] fair opportunity to the ownership of the minimum threshold of primary goods and merely assumes that actors possess the capacities needed to effectively use these resources.... On the dimension of moral and intellectual capacities and skills, Rawls concludes that any variations above the minimum threshold [of primary goods] are acceptable and consistent with the principles of justice as fairness. Ultimately, Rawls treats as an assumption what equality of capacity treats as a fundamental feature of political equality. (p.236; footnotes omitted)
Perhaps Rawls would indeed be untroubled by some inequalities in capacities or, to put it differently, perhaps he doesn't focus explicitly enough on ensuring that individuals engaged in democratic deliberation have roughly equal capacities ("roughly" because obviously some inequality in capacities is unavoidable: not everyone has the eloquence of a Martin Luther King).

However, it's worth considering in this connection an implication of Rawls's views as expressed in A Theory of Justice [TJ]. There he says that "the primary social goods, to give them in broad categories, are rights and liberties, opportunities and powers, income and wealth," and -- importantly -- self-respect, i.e. "a sense of one's own worth" (TJ, 1971 ed., p.92). The sense of one's worth depends on a number of things, and one of them, Rawls suggests, is an ability to participate in the public life of one's society, as the following passage (p.101) indicates:
...the difference principle [i.e. the principle that social and economic inequalities must benefit the least advantaged] would allocate resources in education, say, so as to improve the long-term expectation of the least favored.... And...the value of education should not be assessed solely in terms of economic efficiency and social welfare. Equally if not more important is the role of education in enabling a person to enjoy the culture of his society and to take part in its affairs, and in this way to provide for each individual a secure sense of his [or her] own worth. (emphasis added)
Thus, given the importance of self-respect in Rawls's view and the effects of the difference principle, the Rawlsian just society, at least as described in A Theory of Justice, would likely be one in which the large majority of adults would have the capacities needed to participate effectively in democratic deliberation and, more broadly, in their society's public affairs.

Knight & Johnson on pragmatism and democracy

I've recently finished reading Jack Knight & James Johnson's The Priority of Democracy: Political Consequences of Pragmatism.  (NB: I haven't read it with the care I would if I were writing a proper review of it; I skipped some of the footnotes and skimmed a few bits of the text here and there. So take this post for several thoughts on the book, nothing more.)

The Priority of Democracy maintains that democracy -- meaning both political argument and voting -- is able to perform certain tasks that other kinds of governance mechanisms cannot. When it comes to "facilitat[ing] effective institutional choice" and "addressing the ongoing conflict that exists in modern society" (p.20), democratic institutions, when operating under the right conditions (an important proviso), have an advantage over markets, courts, and bureaucracies, Knight and Johnson (hereafter K&J) contend.

K&J say that democracy is not necessarily the best way to deal with any given substantive issue, but it is the best way to decide how and through what means particular issues should be addressed. In this sense democracy has what they call a 'second-order priority'. A properly functioning democratic system constantly monitors its own performance and that of its component parts to ensure that they are working effectively. The point of democracy, on K&J's view, is not to bring everyone to the same views but to ensure that contending positions clash productively, over the same conceptual landscape so to speak, rather than talking past each other, and that all sides get a roughly equal chance to be heard. Drawing on Dewey's pragmatism, the authors favor institutional experimentation and argue that good institutional performance depends on effective democratic participation, which in turn requires what they call 'equal opportunity for political influence'.

The book, as might be gathered, proceeds at a high level of abstraction, despite the authors' claim -- not put in exactly these words -- that they are bridging the gap between normative and explanatory theory. They pay virtually no attention to the literature on historical institutionalism and to the actual historical record of institutional performance. Instead their main engagements are with rational-choice models of institutions, on the one hand, and theorists of deliberative democracy on the other. Against Habermas, they maintain that democratic deliberation should aim not to bring people to consensus or agreement but rather to "structure the terms of disagreement." (On the rational-choice point, see the end of this post.)

K&J write that "[t]heoretical analysis can make important contributions to our understanding of issues of institutional performance, but alone it cannot provide definitive answers to questions of actual effect. Such answers can only come from the cumulative experience of using the various institutions at our disposal" (p.165). Despite this statement and others like it, they make, as already mentioned, little or no effort to examine the historical record of such "cumulative experience" to see whether, or to what extent, it might support their argument.

That said, I'm inclined to agree with their critique of markets, which as I understand it boils down to saying that markets require demanding conditions in order to function properly but -- and here is the contrast with democratic institutions -- markets are not good at monitoring their own performance and ensuring that the necessary conditions for their effective functioning exist. In their terminology, markets, unlike democratic institutions, are not "reflexive."

However, like markets, democracy requires demanding conditions -- such as equality of influence -- to work properly, and meeting those conditions is simultaneously a normative imperative and a practical prerequisite of effectiveness and legitimacy, K&J argue. But they don't go into much detail about the kinds of state intervention that would be required to ensure something approaching 'equal opportunity for political influence'. 

The authors view political actors as mostly (though not always) self-interested, rather than as acting from a conception of the public interest (p.281). 'Winners' will seek to keep their advantages, while 'losers' -- the relatively disadvantaged -- will seek to change institutions in their favor. The push-and-pull of such democratic contention involves, they say, "an inherent learning process" (p.281) and presumably conduces to (gradual) improvements -- though the words "progress," "reforms," and "improvements" are not much in K&J's vocabulary, preferring as they do the more antiseptic diction of academic political theory. Note, too, that for 'losers' (i.e. those previously or currently disadvantaged) to play a constructive part in democratic struggles, they have to have resources and influence to begin with (hence the 'equal opportunity for political influence' condition).

The authors' range of reference is impressive and their book is clearly the result of much thought. Those with a professional interest in democratic theory and social choice theory will want to read it if they haven't already.  

However, as someone without such a professional interest, I found the book to be somewhat frustrating. K&J claim to reject the dichotomy between ideal and non-ideal theory, but I think the book is mostly the former, in spirit if not under the technical definition of 'ideal theory'. It makes a good theoretical case for a kind of democracy that does not presently exist, at least not in the U.S., but offers few concrete suggestions about how to bring such a democracy into being. Since the authors never said they would do that, I suppose this amounts to criticizing the book for something it never claimed to do. However, the authors do say that political theorists have explanatory and analytical tasks as well as normative ones, and I think the explanatory part of their argument could have benefited from a more historical and empirical perspective.


In terms both of its ambitiousness and its rather ponderous and repetitive style, The Priority of Democracy may bear some comparison with Rawls's A Theory of Justice (TJ). Of course The Priority of Democracy is less monumental in length and scope than TJ -- most books are -- and not only its 'project' but its targets are different. The latter fact partly reflects, I'd suggest, the difference in the intellectual climate between the mid-twentieth century, the era of which TJ is a product, and the early twenty-first century. To oversimplify for the sake of contrast, Rawls's main target in TJ was utilitarianism, whereas K&J take aim at what might be called market fundamentalism and, by extension, neoliberalism (though they don't use these terms in the book). Neoliberalism really came to the fore in the late '70s and early '80s, well after TJ was published. And the sources of inspiration are different: for Rawls it was the social contract tradition and (especially) Kant, for K&J it's pragmatists like Dewey, Richard Rorty, and Richard Bernstein. (Note that Dewey's name appears only twice in TJ, both times in a footnote.) K&J also frequently cite Amartya Sen's Development as Freedom and Richard Posner's Law, Pragmatism and Democracy, among others. 

At the beginning of the book K&J criticize Rawls, charging Rawlsian ideal theory with neglecting "the tasks of showing how any institutional arrangement governed by [the] principles [of justice] could emerge or sustain itself" (p.16). But as already indicated, I found their own account of institutional emergence and functioning to be too abstract and not empirical enough.

Finally, since I have criticized K&J for ignoring the literature on historical institutionalism (including the work on path dependency), I should mention that this a conscious choice on their part: they acknowledge that "several brands of institutionalism have emerged in recent years" (p.17) and say that they focus on rational-choice models of institutions for several reasons, among them that such models are usually and mistakenly assumed to "underwrite a robust challenge to democratic theory" (p.18). By making their case on this supposedly unfriendly terrain, they write, "we tacitly assume a rather substantial burden of argument" and, via a "distinct interpretation" of rational choice, "aim to place pressure on advocates of rational-choice approaches to explore more carefully the ways their analytical proofs, their explanatory claims, and their normative pronouncements hang together" (p.18). I haven't gone into this aspect of the book in this post and will leave others to judge whether and to what extent K&J succeed in this particular aim.

The Emersonian Obama

There is much that might be said (and no doubt much that has already been said) about Obama's Nobel acceptance speech. After a reading of the text that admittedly has not squeezed out every nuance, I highlight three points that seem especially noteworthy:

(1)
In dealing with repressive and so-called rogue regimes, the speech called for balancing sticks and carrots, sanctions that "exact a real price" and diplomacy. Although "engagement with repressive regimes lacks the satisfying purity of indignation," he said, sanctions standing alone are not enough. "No repressive regime can move down a new path unless it has the choice of an open door." The recently announced U.S. policy on Sudan in fact followed this carrots-and-sticks approach.

(2) He insisted that justice and "a just peace" require the amelioration of poverty, in addition to the standard emphasis on civil and political rights. Economic and environmental security (including action on climate change) are linked here to traditional security. Indeed, this part of the speech could have been lifted from a textbook on "human security."

(3) Obama attempted, particularly in the closing passages, to reconcile a "clear-eyed" view of human imperfection with the possibility of progress. This might have recalled for some listeners parts of King's "I have a dream" speech, and indeed Obama quoted King on rejecting "despair as the final response to the ambiguities of history." And in a line that suggested at least one of his speechwriters might recently have been reading Thoreau or Emerson, Obama declared: "Let us reach for the world that ought to be -- that spark of the divine that still stirs within each of our souls."

While there were perhaps some tensions in the speech between the "clear-eyed" and the more visionary elements, I don't think, contra the view of one of the commenters on the NewsHour this evening, that the speech was "philosophically incoherent." No American president at this juncture in history could possibly give a full-throated, unambiguously Wilsonian speech, but neither was it an option, particularly in view of the occasion and the context, to end on anything other than a note of solidarism, hope, and uplift. If anything, the speech erred too far in the direction of a quasi-Sisyphean view of the world. But Obama is no longer campaigning, he is governing and making difficult decisions, so it is only natural to expect that his speeches will strike more ambiguous chords than they did during the campaign.
